Account: Any account created by a User following the completion of MapsArch's registration process.

Content: Includes all content available via the Services, such as text, graphics, logos, names, button icons, features, code, images, data, photos, videos and other materials.

MapsArch: mapsarch sa, a Swiss corporation registered in the Commercial Register of Geneva, Switzerland, under UID CHE-476.249.887, along with any affiliates or related entities.

II. ACCEPTANCE OF THE TERMS OF USE

Our Services are continuously updated to ensure they provide the latest architectural content and tools, serving as a valuable resource for those seeking architectural knowledge or wishing to share their projects.


IV. REGISTRATION

To access certain Services, you must register with MapsArch and create an Account.
During registration, you must provide accurate and complete information. MapsArch reserves the right to suspend or terminate your Account and access to the Services if any information provided is found to be inaccurate, incomplete, or outdated.


You are responsible for all activities that occur under your Account and must maintain the confidentiality of your login credentials. Immediately notify MapsArch of any unauthorized use of your Account.


MapsArch is not liable for any losses due to unauthorized account use, but you could be held responsible.


By providing MapsArch with personal information and data in relation with the creation of an Account, you expressly authorize MapsArch to collect and process such information for the purpose of management of the Services. YOU EXPRESSLY ACCEPT THAT MAPSARCH MAY PROCESS AND SAVE YOUR PERSONAL INFORMATION AND DATA outside Switzerland AND EUROPE.


MapsArch has implemented reasonable and appropriate technical and organizational measures to help secure your files against accidental or unlawful loss, access, or disclosure. You agree that these measures are MapsArch’s only responsibility with respect to the security and handling of your Content and personal data and are sufficient in the light of any non-disclosure obligation of MapsArch. MapsArch will not be responsible for maintaining backup files. Upon termination of your Account, MapsArch may, but is not obligated to, delete your Content. V. ACCOUNT AND PAYMENT TERMS

Fees are specified during the registration process and must be paid in advance. All fees are non-refundable.


Failure to pay the Fee results in immediate termination of the Services.
Subscription periods automatically renew under the same terms unless cancelled before the renewal date. You may cancel your subscription at any time; however, no refunds are provided for cancellation. Subscription fees continue to accrue regardless of whether you actively use the Services. Any unused part of a free trial period, if offered, will be forfeited when you subscribe for a paid plan during the trial period.


VI. USE OF THE SERVICES

  • General Conditions
    You are granted access to the Services under the condition that you do not modify any part of the Services or use them in a manner that interferes with their intended operation. You bear sole responsibility for any Content you upload or actions you take within the Services and must comply with all applicable laws and regulations. MapsArch reserves the right to modify or discontinue any aspect of the Services at any time.
  • Your Content
    You have the sole responsibility to ensure that your Content complies with all applicable laws and regulations and these Terms of Use and therefore:

  • You represent and warrant that you dispose of the necessary rights and authorizations to use and upload your Content. In particular, you agree that you will not submit material that is copyrighted, protected by trade secrets or otherwise subject to third party proprietary rights unless you have permission from its owner to display and distribute such material.

  • You also warrant that your Content is not contrary to public policy, nor any applicable laws, regulations or boni mores.

  • MapsArch shall determine in its sole discretion whether any Content is appropriate and complies with the present Terms of Use. MapsArch may at any time, without prior notice and in its sole discretion, remove Content and/or terminate any Account for materials uploaded that it finds inappropriate or in violation of the present Terms of Use.

  • Any uploading of Content in violation of the present Terms of Use may result in your personal liability.

  • Users and Visitors may report to MapsArch any Content that does not comply with the present Terms of Use, because it is unlawful, offensive or contra bonos mores or because it infringes the proprietary rights of a third party. Such notifications to MapsArch shall be made exclusively through the [email protected] email address.


VII. INTELLECTUAL PROPERTY
  • Your Content

    MapsArch does not claim ownership of your Content and you are free to share your Content with anyone else. However, we need certain legal permissions from you (known as a "licence") to provide the Services. When you post or upload Content that is covered by intellectual property rights (such as photos or videos), you grant us a perpetual (even after you stop using the Services), irrevocable, worldwide, non-exclusive, free of charge, sublicensable and transferable license to use, store, reproduce, transfer, modify (including creating derivative works or translations), communicate, publish and display and/or distribute the Content that you have submitted, this for the sole purpose of providing our Services. You hereby expressly agree that your Content may be processed by third parties mandated by MapsArch and acting under MapsArch’s responsibility.

    You undertake to retain all ownership rights on your Content and to continue to have the right to freely use such material after submitting your Content to MapsArch.

    MapsArch does not permit and will not tolerate any infringement of intellectual property rights in the Services. MapsArch may remove, without prior notice, any Content if notified that such Content infringes on another's intellectual property rights.

    MapsArch expressly disclaims any liability in connection with your Content.

    You can remove your Content individually or all at once by deleting your Account.

    Unless you expressly disable this feature on your Account upon registration or further notice to MapsArch in writing or through the [email protected] email address, you hereby grant to MapsArch permission to make (some of) your Content available on the Website’s homepage, on a partner’s digital platform or on MapsArch’s advertising materials as illustrations for promotional purposes only, provided that MapsArch clearly indicates the ownership of such materials. Other than for such limited use, MapsArch will not use your Content commercially.

    You may view other Users’ Content made available by MapsArch solely for your personal and non-commercial use and in the respect of the present Terms of Use. In particular, you must not attempt to distribute, commercialize, transmit, license, copy or lease any other Users’ Content without such Users’ prior authorization.

  • MapsArch’s Content

    MapsArch's Content is the exclusive property of MapsArch and its licensors and is protected by copyrights, trademarks, trade secrets, or other proprietary rights.

    MapsArch's Content may not be downloaded, copied, reproduced, distributed, transmitted, displayed, sold, licensed, or otherwise exploited without the prior written consent of MapsArch.

    You agree not to use or exploit MapsArch's Content in any manner inconsistent with the present Terms of Use. You are not allowed to modify MapsArch's Content or to create derivative works based upon MapsArch's Content.

    You may not reverse engineer, decompile or disassemble MapsArch’s Content where applicable law permits it despite this limitation.

    All rights not expressly granted in the present Terms of Use are reserved to MapsArch and its licensors.

VIII. TERMINATION
MapsArch may terminate your Account immediately if you breach these terms of Use or if MapsArch is unable to authenticate any information you provide to MapsArch.

MapsArch remains free to suspend or terminate your access to the Services at any time without notice, in particular by suspending or terminating your Account, in case MapsArch determines, in its sole discretion, that such measure is necessary as a consequence of your violation of the present Terms of Use or any other MapsArch policy or if MapsArch decides to interrupt the Services for any reason.

In no event shall any refunds be paid.

Following termination of your Account, MapsArch may remove some or all of your Content from its servers or elect to retain it.


IX. AMENDMENT
MapsArch reserves the right to amend these Terms of Use at any time without notice. By continuing to use the Services after an amendment, you agree to be bound by the updated terms.


X. LIABILITY

MapsArch provides the Services "as is" without any warranties, express or implied. MapsArch disclaims all liability for damages that may arise from your use of the Services. You agree to indemnify and hold MapsArch harmless from any claims (including attorney’s fees) resulting from your use of the Services.

The Services are managed and offered by MapsArch from its corporate headquarters in Switzerland. MapsArch makes no representations that the Services are appropriate or available for use in other jurisdictions. Those who access or use the Services from other jurisdictions do so under their own responsibility and are responsible for compliance with locally applicable laws.


XII. MISCELLANEOUS
If any part of these Terms of Use is found to be invalid or unenforceable, the remaining terms will continue to be in full effect. MapsArch's failure to enforce any right or provision of these Terms of Use does not constitute a waiver of such right or provision.


XIII.GOVERNING LAW / JURISDICTION
These Terms of Use are governed by the laws of Switzerland without regard to its conflict of law provisions.

The place of jurisdiction shall be Geneva, Switzerland, subject to an appeal to the Swiss Federal Supreme Court. Notwithstanding the foregoing, MapsArch reserves the right to institute legal proceedings at your registered office or place of residence.
